Himan Rights Law Coursework Example | Topics and Well Written Essays - 2000 words
Himan Rights Law - Coursework Example It is evident from the study that people in the United Kingdom have enjoyed a lot of individual freedoms and liberties which usually fall into conflict with so many other laws. Consequently, the European Convention on Human Rights (ECHR) was drafted in 1950,to integrate these liberties. However, it was not until the year 2000 that the convention rights were adopted in the United Kingdom through the Human Rights Act. In order to use the convention rights, one had to take a case to the European Courts on Human Rights in Strasbourg. This was extremely expensive to citizens and was also extremely time-consuming. The 1997 white paper ââ¬Å"Rights Brought Homeâ⬠rightly states that: It takes on average five years, to bring a case into the European Court of Human Rights once all domestic remedies have been exhausted; and it costs an average of à £30,000. Bringing these rights home will mean that the British people will be able to fight for their rights in the British courts ââ¬â without this undue delay and expense. One of the most critical functions is to ensure that, at all times, there is compatibility with the laws as stipulated by the Convention Rights. The Act gives individuals a complete description and summary of the freedoms and liberties that they are supposed to enjoy as citizens. It ensures that everyoneââ¬â¢s rights are respected also, just as ECHR does. The Act also goes ahead do state that rights come with responsibility too. This means that there are cases and situations when these rights may need to be limited, such cases being when crime and public health need to be addressed. Apart from protecting the rights of individuals, the Human Rights Act also requires courts of law to obey the laws that Parliament passes. Courts are only allowed to interpret the laws as is, without altering them in any way whatsoever. Nevertheless, the Act allows higher courts the power to determine that a given order cannot be put into use for the sole reason t hat the law contravenes the rights described in the Convention. When this happens, congress is required to amend the various section of that law before it is set to use again6. Since the Human Rights Act was enacted, courts are now obliged to look at The Convention Rights at all times when deciding how cases should go. This is a tremendouslylarge shift from the way things used to be before. Convention rights were looked at only when the UK laws were not clear. Part 2: How does the HRA work? The Act requires all courts and tribunals to interpret laws and effectively put them into use in ways that are compatible to the Convention rights. Rightly so, when this is impossible, a court may revoke or, subordinate legislation or, if it is a higher court, make a declaration of incompatibility. This allows for the amendment of the law to make it in line with

How to Manage Negotiation - Using Mistakes to Explain Research Paper
How to Manage Negotiation - Using Mistakes to Explain - Research Paper Example The purpose of negotiation is to discover the circumstances, and to obtain a solution that is satisfactory to both group. Itââ¬â¢s helpful to have uniformity in the employees where distinct kind of person is able to bring about different returns to the business. But this uniformity frequently leads to change of judgment among two workers or two different departments. Conflicts are a part of working situation and as a manager cannot remove the dispute in total; all they could do is to direct them in a manner that it won't influence the level of productivity. Managing Negotiation: Efficiently managed negotiations will leads to agreements and that increases the worth of the organization. Further, they present extremely better profits per investment. On the other hand, unsuccessfully completed negotiations, eventually result in exhausted capital and improved expenses to the organization, creating both the manager and the organization in a difficult where capital effort makes it harder to create the lost position and attain constructive consequences. The faster they manage them, the more the benefits will be for the business if not the conflicts will provide means to destructive performance and lack of group hard work, and as an it causes low output. Mistakes in Negotiation: Negotiation is a hard skill as it needs momentum, in immediately, in the other person's mind and in oneââ¬â¢s own. While the managers have to concentrate on positives, it is uniformly significant not to neglect the negative feature of negotiations. There are a set of mistakes that all of us make and we need to be conscious of to be at our most excellent when negotiating. These mistakes happen all the moment. In a number of situations, they occur by mistake. At other instance, some people create these mistakes on intentionally. They overlook conservative understanding and perceptive recommendation and decide to negotiate in a way that brings no success to the negotiation. There are a number of mistakes that negotiators can create and should evade at all costs in order to be a successful negotiator. The two of them are discussed here. 1. Neglecting the Other Side's Problem: A person alone cannot make negotiation the other party is equally involved in it. Therefore, one must take into consideration the other persons interests or problems. The parties should try to place themselves in the other's place. The parties should not merely suppose that their bad doubts will turn out to be the dealings of the other party. They should not accuse the other for the problem. Each party should try to give suggestions which would be pleasing to the other party. ââ¬Å"The objective of negotiation is to seek a win ââ¬â win solution and if win and lose solution happens than you are neglecting the other sideââ¬â¢s problemâ⬠(Lalitbhojwani). Consider the example of a manager firing one of the employees in the organization. The manager argues and fires the staff for a long time for his low performance, without asking the reasons for his poor performance. According to the employee, he/ she will be some personal or official problems which lead the employee to perform poorly. In this situation, the manager needs to listen carefully to the problems of the employees so that the manager can solve the problem very easily. Considering the opinions of outside parties is useful.

Inter-Cultural Teams Essay Example | Topics and Well Written Essays - 2500 words
Inter-Cultural Teams - Essay Example People who are assigned to inter-cultural teams often begin working closely with a group of new team members, and the welfare of the new group tends to displace the welfare of the individual as the team attempts to build cohesiveness and a sense of interdependence. (Wellins, 1990, 76) As with self-management, the use of teams in the workplace also may best be thought of as lying on a continuum. At one end, teams with a low degree of interdependence consist of employees who rarely see each other and perform their tasks without exchanging information or materials. At the other end of the continuum, teams with a high degree of task interdependence consist of employees who frequently interact and constantly exchange materials and information to complete their tasks.1 On a highly interdependent team, successful task accomplishment obviously depends greatly on the interaction of employees. Our definition of a inter-cultural teams, however, implies very little variation. Thus, we assume that resistance to inter-cultural teams is, essentially, resistance to interdependent teams. The resistance to inter-cultural teams can be due to a person's philosophy about teamwork rather than to his or her views on particular task characteristics (such as a task's degree of self-management). For example, when introduced to the idea of inter-cultural teams, an i... Thus, an employee's philosophy about working in a highly interdependent fashion, rather than in an independent manner, may be a key factor in determining that individual's support of, or resistance to, inter-cultural teams. (Adler, 1997, 117) Collectivism versus individualism When people value the welfare of the group more than the welfare of the individual, they are called "collectivists." Hofstede defines "collectivism" as a tight social framework in which a person's "identity is based in the social system" and his or her "belief is placed in group decisions" (1980b: 48). People from collectivistic cultures tend to put aside their own self-interests in deference to the interests of their group. For example, several studies have found that people in South Korea and Sweden (cultures that are highly collectivistic) disregard individual performance differences when determining employee rewards. Consistent with this, collectivists believe in cooperating rather than competing, following a group purpose rather than individual agendas, and promoting the welfare of the group over that of the individual members. In addition, people from collectivistic cultures fear being ostracized personally or bringing shame to their group for behavior not contributing to the welfare of the group. Conversely, people in "individualistic" cultures tend to put forth and promote their own welfare over the interests of their group or organization (Hofstede, 1980a). People in the United Kingdom (a highly individualistic culture) had higher incidences of social loafing than did the Chinese (a highly collectivistic culture) when working on an interdependent group task. People in the United Kingdom also prefer reward distributions that

CHURCH VISIT - WESTMINSTER ABBEY IN LONDON Essay
CHURCH VISIT - WESTMINSTER ABBEY IN LONDON - Essay Example There are four large statues of Moses, St. peter, St Paul and another of king David on either side of the alter which give the whole building a serene feeling of holiness. The pulpit where the sermon is conducted is made of gilded wood and from where the sermon is conducted on Sundays. As I walked the length of the abbey, I reached an entrance on the end where the evensong is conducted. There is where I met vergers, who looked as though they were on guard duty at the door, but when I asked them about the evensong, they let me in pleasantly and gave me a program which explains the service; they also added my name to the list of people to sit in the quire. From their on, I just watched what other people were doing and copied them. We were then later issued with pamphlets with the weekââ¬â¢s services and music along with the evensong service sheet; which basically tells one when to stand and sit or when to respond. The service then soon began when the whole congregation was signaled to arise in the singing of the poem Tallis in manus tuas, Domine (after Thomas Tallis). The poem was also in the pamphlet issued to the rest of the congregation and soon, I was in rhythm with the rest of the congregation in the recitation of the Tallis in manus tuas, Domine (Tallis, pg 89). Soon after, we completed reciting the Tallis in manus tuas, Domine the preacher who had been seated at the alter came in to the pulpit and gave a brief reading from the Bible only and excluded a sermon. After the reading, the choir which mainly consisted of around thirty boys who were seated at the quire and wore red robes, arose and what followed left me speechless. The boysââ¬â¢ singing of Purcell Lord, how long wilt thou be angry was really the most wonderful thing I have ever heard (Tallis, pg 112). Just like me the rest of the congregation was left also wanting for more. I guess its one of the major reasons why the
